Colorado County to pursue three% cannabis tax

Grant County voters will make a decision regardless of whether marijuana customers need to spend a three% tax on recreational marijuana solutions in November.

Right after passing an emergency ordinance in 2018 to tax pot sales, Grant County officials returned $five,000 final year to Rocky Mountain Dispensary, the county’s sole marijuana retailer, for the reason that state law needs a pot tax to go to the voters in the course of a statewide common election.

In a 2019 press release, District Lawyer Jim Carpenter mentioned that “scrutiny by the Blue Mountain Eagle brought the concern to light, causing a reconsideration of the legality of the ordinance.”

Carpenter mentioned Rocky Mountain Dispensary had been collecting a recreational marijuana tax from its consumers in the course of the final quarter of 2018.

“The retailer, in very good faith, believed there was a tax and was desirous of providing back to the neighborhood per the earlier campaign to enable recreational marijuana sales inside the county,” Carpenter mentioned.

The county, mentioned Carpenter, necessary an ordinance to obtain the taxes, and with the year coming to a close, they have been operating out of time, so they passed the ordinance.

The issue was that the ordinance did not refer the tax measure to voters for approval, as essential by state law.

Haley Olson of Rocky Mountain Dispensary mentioned she estimates that the tax would produce more than $one hundred,000 in income annually.

“It’d be seriously substantial, she mentioned. “I imply, that is a considerable quantity of funds for a neighborhood this modest.”

Meanwhile, Olson mentioned the dispensary has voluntarily held the funds back and donated to several neighborhood applications, from four-H to the wrestling group.

“I have a large chalk wall in my workplace, that is from floor to ceiling,” she mentioned. “And I just donate to all types of stuff. We get to select exactly where it goes.”

She mentioned the only organization that has refused a donation has been the Grant County Sheriff’s Workplace Search and Rescue.

County Judge Scott Myers mentioned what he likes about the pot tax is that the only individuals who will be taxed are these acquiring marijuana solutions.

“It’s a user tax,” he mentioned. “So no a single else is obligated to spend any of that tax. Only distinct individuals spend it. No a single will ever have to spend a pot tax right here locally at least for now unless they’re shopping for solutions.”
